The U.S. Supreme Court has been asked to review a Texas case and determine whether when a homeowner exercises his Second Amendment rights he gives up his Fourth Amendment rights. In short, does the Second trump the Fourth?
This is all about the apparent rise in recent years of blatant 'no-knock' and often warrentless forced home entries by L.E. The 4th is supposed to protect against this and yet it has seemed way too often that just having knowledge (or suspicion) of a householder's ownership of firearms is enough to charge in unannounced. The consequence then can tragically be the loss of life of the home owner, as he justifiably goes for his gun to deal with intruders.
